RELEASE OF LIABILITY & ASSUMPTION OF RISK TERMS & CONDITIONS
I, hereby agree to the following: In consideration of my participation in Karuna Yoga Journeys Yoga program I registered for as well as the associated accommodations, meals, events and activities (collectively, “Retreats,”)
I agree as follows:
1. Health and Safety
Trip Insurance is recommended to attend any KYJ event– we recommend you purchase a comprehensive “Cancel for Any Reason” policy. In the event you are ill and cannot attend your event, or for any other reason that you can’t attend, you will need to submit a claim to your trip insurance company for reimbursement (reimbursement subject to the approval/terms of your specific policy). There are no refunds from Karuna Yoga Journeys on your final event payment. Karuna Yoga Journeys is not a trip insurance provider and is not responsible for the specific terms of your policy. Insurance reimbursement for a Karuna Yoga Journeys is not within Karuna Yoga Journeys control and this information does not constitute insurance advice. Please consult an insurance professional and understand your policy coverage limits so there are no surprises for you. As a reminder, upon booking, you agree to our Terms of Service below.
2. PAYMENT TERMS, CANCELLATIONS + ITINERARY CHANGES
Retreat and YTT Pricing + Itinerary Changes
All prices are per person and are set well in advance of the start date. Prices vary depending on a variety of cost factors, with peak travel times being the most expensive. You can always find pricing on the website. Prices include event costs only; they do not include airfare to and from the event and ground transportation (unless noted on the website). Resort gratuities are never included in event price. KYJ believes in fair pricing for all event attendees – all prices are set and non-negotiable.
While every effort is made to keep to all published itineraries, we reserve the right to make changes for your convenience. In some cases, weather conditions or “acts of god” (e.g. pandemic) can necessitate an alteration in the event itinerary, such as the dates of the event, and this does not constitute any reason for refund. No refund for unused services will be considered.
For example, if there are government travel restrictions due to an “act of god” (e.g. weather, pandemic) we will need to change the itinerary/dates to a later time when we can travel without restrictions. We do not offer refunds for itinerary changes to new dates. In the event you can’t make the new itinerary dates, we will offer you a full credit for use on any Karuna Yoga Journeys event that is valid for two years. Karuna Yoga Journeys reserves the right to correct printing errors or omissions at any time, unaffected portions will continue to remain valid.
3. TRIP INSURANCE & DOCUMENTS
Trip Insurance
Guests are required to purchase individual trip insurance for international retreats and trainings
Please check within your country for insurance coverage. We HIGHLY recommend purchasing a cancel for any reason trip insurance as it is the most comprehensive coverage you can purchase. Please note KYJ is NOT responsible for denied claims or insufficient coverage as we are NOT a trip insurance agency. Cancel for Any Reason coverage is the only policy with the widest “net” to protect your investment.
KYJ will not be held responsible for any delay, additional expense or inconvenience that may be caused directly or indirectly by events outside of our control (ie: late arrival/departure of flights, civil disturbance, fire, flood, cyclones, severe weather, acts of God, and acts of government, machinery or equipment failure, or cancellations for any reason.) No refunds will be given for “no shows” or days not used resulting from the above aforementioned.
Travel Documents and Immunizations
It is the responsibility of each traveler to obtain all required travel documents including Visas. It is your responsibility to purchase correct immunizations. Please contact your nearest travel clinic for the latest requirements. We are here to advise.
4. ROOMMATES
Roommate Assignments
Rates are per person. Twin or otherwise advertised shared rooms require shared occupancy for the specified room rate. If you book a shared room without specified roommate(s), we will do our very best to match you with your desired room type and price point. In the event we can’t find you a roommate for your first pick, we will present you with different rooming options.
5. ALLERGEN ENVIRONMENT
Food Allergies and Allergies Notification, Acknowledgement, and Release of Liability
An environment free of allergens, including but not limited to food allergens, CANNOT be guaranteed. Therefore, the released parties cannot guarantee that any particular food product is free of all traces of any particular allergen, that consumption of a food product will not result in some form of allergic reaction, or that the participant will not come into contact with any allergens while in attendance on KYJ event s. The undersigned acknowledges and agrees that i) she/he is aware of such risks and that participation in the event will expose the participant to food, activities and persons that may result in exposure to allergens and injury and, in that regard and assuming such risks, the undersigned hereby fully releases and discharges the Released Parties from any and all liability and/or responsibility to the participant, the undersigned, or any third party for death and/or injuries to the participant, and/or any direct, indirect, punitive, incidental, or any damages that arise out of or relate to participant’s participation in KYJ events and/or exposure to food allergens.
6. Definitions. “Activities” shall include walking, hiking, running, yoga, pilates, core strength exercises, dynamic and joint mobility exercises, stretches, training, instruction and all other activities associated with the Retreat. “Risks” shall include, without limitation, vehicular traffic, road and trail conditions, health conditions, weather, equipment failure, driver error, participant error, food provided, facilities, actions of other people, and the actions, negligence and carelessness of the Released, as defined below. “Released” shall include the Retreat organizers, booking agents, hosts, website hosting partners, retreat hosts, leaders, volunteers, officers, directors, employees, contractors and agents, the owners or operators of any Retreat facilities or equipment provided, the sponsors and partners of the Retreat.
7. Certification, Acknowledgements, Assumption of Risk, Health and Safety. I hereby certify that there are no health-related reasons or problems that preclude or restrict my participation in the Retreat, that I am physically fit, able to walk on unstable surfaces, such as trails, paths, grass and roads, and have not been advised otherwise by a qualified medical person. I hereby assume all risks of participation in the Activities and the Retreat, including without limitation all Risks, whether such risks are caused (a) by the negligence or carelessness of the retreat leaders, (b) the negligence or carelessness of myself or (c) from dangerous or defective equipment or property owned or provided in any way by the Released. I acknowledge that the Retreat is, or may a test of my physical and mental limits and carries with it the potential for serious injury, property loss and even death.
8. Waiver, Release and Agreement Not to Sue. I, and on behalf of my executors, administrators, heirs, successors, assigns, and as the parent or legal guardian of a participant of a Retreat, agree NOT TO SUE or make a claim against the Released Parties for any and all damage, death, injuries, loss, or harm that occur during the Retreat or while travel to and from the Retreat and Retreat Activities. This release includes, but is not limited to, claims for strict liability for any abnormally dangerous activities in which I choose to participate in the course of the Retreat, whether caused by negligence or carelessness of the Released or otherwise.
By agreeing to the terms outlined here I hereby release and discharge my rights and claims for damages or liabilities that may occur as a result of participation on a KYJ event.
9. Indemnification and Hold Harmless. I, and on behalf of my executors, administrators, heirs, successors, assigns, and as the parent or legal guardian of a participant of a Retreat, hereby agree to indemnify and hold harmless the Released and each of them from all liabilities, causes of action, claims and demands that arise from my acts or my failure to act, including my own negligence, during or relating to the Retreat.
I, agree to indemnify and hold harmless the Released and each of them from all liabilities, causes of action, claims and demands that arise from any loss, liability or damage, including 2 reasonable attorney’s fees incurred in any suit, demand or legal action arising out of any alleged injury, damage or death resulting from engaging in any Activities, participation in the Retreat, or is alleged to or did result from the negligence or carelessness of any person. In accordance with this promise, I shall reimburse the Released Parties for any damages, reasonable settlements and defense costs, including attorney’s fees that they incur because of any such claims made against them including through appeal.
I agree that in the event of my death or disability, the terms of this agreement, including the indemnification obligation in this Section 4, will be binding on my estate, and my personal representative, executor, administrator or guardian will be obligated to respect and enforce them.
10. Inherently Dangerous Activities. Retreat Participant acknowledges that he or she is willfully and with full knowledge participating in certain activities, including but not limited to a program of fitness and physical exercise, and travel in developing countries that are inherently dangerous.
I am entirely responsible for my own personal safety, health, and mental, physical, emotional, and general well-being during and after the Retreat. I release the Retreat Organizers and their representatives, and any of their employees, assistants, and affiliates, of any liability for any injuries or damages mentally or physically I or any of my family members might incur during or after the Retreat. I understand that the Retreat is in no way psychotherapeutic or medical in nature. The Retreat is not involved with the treatment of disease of any kind and does in no way substitute for medical diagnosis or treatment.
Retreat leaders and teachers do not treat, prescribe, or diagnose any illness, disease, or any other physical or mental disorder. Any personal advice or answers to my questions that are given to me on this Retreat are for entertainment purposes only. I release Retreat Organizers and their representatives and any of their employees, assistants, and affiliates from any injuries or damages mentally or physically that I or any of my family members might incur during or after this Retreat as a result of following any advice given to me on this Retreat.
I release Retreat Organizers and their employees, assistants, and affiliates from any obligation to fulfill any claims about this Retreat that have been printed or spoken in any tapes, lecture, letters, literature, the Internet, websites, or the news media. I am entirely responsible for my personal safety, health, and well-being during the Retreat.
I hold the Retreat Organizers harmless for anything that might happen to me or to my possessions on this Retreat. I understand that no health insurance nor travel insurance nor medical evacuation insurance is provided by the Retreat organizers, and, if I wish to be insured, I have to do this myself. I have read and understand the foregoing Retreat Waiver. By signing this Retreat Waiver, the participant releases the Retreat Organizers and its representatives from all responsibility and liability.
11. Medical Care. Although I acknowledge that there is no obligation of any person to provide any participant with medical care during, prior to or after a Retreat, in the event medical treatment is provided to me or my child or legal guardian, I hereby consent to such care. Release shall apply to all medical care and such medical care shall be deemed to be an Activity.
12. Personal Property. I acknowledge and agree that I am responsible for my equipment and all personal property during the Retreat and that the Released are not responsible in any way for such property whether it is lost, stolen or damaged.
13. Words and Images. I understand that during a Retreat I may be photographed, videotaped and or my words may be recorded and authorize and allow Karuna Yoga Journeys and its partners to use such images, words and likenesses for marketing, on websites, in brochures or other writings and any other legitimate purpose.
14. Applicable Law, Forum and Attorney’s Fees: I agree that the purpose of this agreement is that it shall be an enforceable release of liability and indemnity as broad and inclusive as is permitted by law. I agree that if any portion or provision of this agreement is found to be invalid or unenforceable, then the remainder will continue in full force and effect. I also agree that any invalid provision will be modified or partially enforced to the maximum extent permitted by law to carry out the purpose of the agreement.
16. Booking, Cancellation, Reservations & Payment.
When paying it is the buyers responsibility to cover all transfer fees.
17. Cancellation Policy
Deposit
A non-refundable deposit of £500 is required to secure your place on the retreat. Your booking is confirmed once the deposit has been received.
Final Payment
The remaining balance must be paid in full no later than 3 months prior to the retreat start date.
Cancellation Policy
• The £500 deposit is non-refundable under all circumstances.
• 120–60 days before the retreat start date: 50% of the total retreat cost is refundable (minus the £500 deposit).
• Less than 60 days before the retreat start date: No refund can be offered.
If your place can be filled from a waiting list, we will always do our best to refund any payments made (minus the deposit and any administrative costs).
There are no exceptions to the above cancellation policies including personal injuries or weather. Karuna Yoga Journeys will not be held responsible for any additional travel expenses incurred in preparation for cancelled retreats including airline tickets, travel delays, flight cancellations or illness. If the retreat or training does not meet the total required number of registrants or the retreat center, Karuna yoga Journeys, it’s partners, instructor and or registrant cancel the retreat, KYJ will refund the entire amount paid, less a specified processing fee. In circumstances where the cancellation is due to due to terrorism, natural disasters, political instability, acts of god or other external events outside our reasonable control, refunds will be offered at the discretion of the company after considering unrecoverable expenses. Please allow for at least 1 month for response to refund inquiries. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights. All guests must sign the “Release of Liability and Assumption of Risk” forms prior to arrival. If this form is not signed prior arrival you will not be allowed to participate in the retreat and no refund will be made. We recommend travel cancellation insurance should your travel plans change. We also recommend that participants acquire medical evacuation insurance. Travel insurance can be purchased through your travel agent.
• Payment in advance must include this Waiver.
• Read and sign and submit this Online Waiver Form.
• Send us your full flight information (arrival and departure) by 30 days before retreat or training starts.
• Pay your balance due via Credit Card/Debit Card/Mobile Money/PayPal.
• Prepare for your Trip! Please visit our travel prep section of our website so you will be fully prepared!
• Consider purchasing Travel Insurance to reimburse you in the event you have to change or cancel your trip or for any unforeseen medical expenses you incur while on your trip.
18. Intellectual Property Agreement
All the course content belongs solely to Karuna Yoga Journeys. It is intended for the use of education of the enrolled student ONLY. All material generated from the course can be used by Karuna Yoga Journeys. No material from the course is permitted to be shared outside the cohort. No recordings are permitted to be filmed for private view or use on any other device unless otherwise expressly permitted by lead trainers in writing.
The course link and personal website log ins are for the use of the enrolled student only, not to be shared under any circumstances. Course lectures, classes and all recordings and download-ables are solely for the viewership of the enrolled attendee, unless express permission is obtained otherwise from lead trainers in writing.
Replay or usage of any course material, meditation recordings or class recordings in any commercial setting is not permitted. Any students in breach of these terms shall be held accountable as Karuna Yoga Journeys sees fit.

Benny started out practicing Hatha and Iyengar yoga from the age of 15, but only discovered Yin Yoga in 2015, finally becoming a teacher in 2017. Since then she has never looked back and continues training in and teaching this wonderful practice wherever and whenever she can. Based in Kenya, she teaches studio classes in Nairobi.
Jordan has been practicing yoga for over 10 years in the US, Europe and Kenya. She received certification in Baptiste Power Yoga with the Africa Yoga Project in Kenya, completed the Karuna YTT in 2018 and recently completed a course in yoga for 12-step recovery.
